Important Notice on Availability
Before you finalize your purchase,
please contact us to verify the availability of the vending machine model you desire. Although our inventory is generally well-stocked, we occasionally experience fluctuations due to high demand, leading to temporary shortages.
1. Purchase Agreement
You agree to buy our vending machines specified below, adhering to the terms of purchase laid out in this agreement.
Conditions:
- No Exchanges: Once ordered, machines cannot be swapped for different models.
- Price Setting Costs: Any adjustments to vending prices are your financial responsibility.
- Product Stocking: Machines are sold without contents. We do not supply or endorse products for stocking; this is your responsibility to arrange with a supplier of your choice.
2. Delivery Details
Delivery Address: You must specify a delivery address at the time of purchase.
Rescheduling Delivery: If you need to reschedule the delivery, please provide at least 24 hours’ notice. Failure to do so may incur a delivery fee payable on the new delivery date.
Entry Challenges: If a machine cannot be accommodated through the designated entryway, it will be left at a suitable nearby location. You will be responsible for its placement and installation from there.
3. Payment Information
- Deposit: A 50% deposit is required upon contract initiation, with the balance due upon delivery.
- Additional Charges: Applicable sales tax and handling fees will be added to your bill at the time of delivery.
- Bounced Check Fee: A $25 charge will apply for any returned checks.
- Cancellation Consequences: Deposits are non-refundable. If you cancel your order, the deposit will be retained by us as compensation for potential losses and administrative costs.
4. Warranty and Service
Our warranty covers only parts, not labor, for a period that varies by the purchase price:
- $1,000-$1,999: 30-day parts warranty
- $2,000-$2,999: 60-day parts warranty
- $3,000 and up: 120-day parts warranty
Parts Replacement: If a part is defective and returned within the warranty period, we will replace it free of charge. However, you will bear the shipping costs. Parts damaged through misuse or vandalism are not covered.
5. Limitation of Liability
Our liability in connection with any purchase is limited to the actual amount paid. We will not be responsible for any indirect losses, such as lost profits or incidental damages.
6. Placement Responsibility
You are solely responsible for the placement and operational success of the vending machines. We offer no guarantees regarding the placement or profitability.
7. Sales Policy
All sales are final with no buy-back options or guaranteed protections against financial loss.
8. Legal Compliance
You must comply with all local, state, and national laws, including obtaining any necessary permits and adhering to zoning regulations.
9. ADA Compliance
Delivered machines are standalone and not initially subject to ADA compliance. Modifications post-delivery may necessitate compliance, which will be your responsibility.
10. Legal Expenses
Should any disputes arise that require legal intervention, the prevailing party is entitled to recover reasonable attorney fees and associated costs from the other party.
11. Governing Law
This contract is governed by California law. Any disputes must be resolved in the courts of Alameda County. You agree to this jurisdiction and waive any objections to it.
